Welcome to Fotello Technologies Inc. ("Fotello," "we," "our," or "us"), the creators of an innovative AI video platform tailored for real estate agents. These Terms and Conditions (the "Agreement") govern your use of Fotello's services, including our software, website, and any related services (collectively, the "Service"). By creating an account or using the Service, you agree to these terms.

If you do not agree, do not use the Service.

1. Acceptance of Terms

By checking the box during sign-up or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you use the Service on behalf of a brokerage, team, or company, you confirm that you are authorized to accept these Terms and Conditions on its behalf.

2. Service Overview

Fotello offers tools and services designed to:

  • Create an AI avatar from a short video you record or upload
  • Generate AI videos featuring your likeness and voice from our video templates
  • Personalize your videos with your listings, photos, and details
  • Apply live camera effects, such as makeup, while you record

3. License

Fotello grants you a limited, non-exclusive, non-transferable license to use the Service for personal or professional purposes in accordance with this Agreement.

Free and Paid Plans:

  • Free plans and trials may include usage limits or restricted features. Videos created during a free trial may have limited access, such as sharing and downloading, until you subscribe.
  • Paid subscription plans are billed in advance and renew automatically at the end of each billing period until you cancel.
  • You can cancel at any time. Once your cancellation takes effect, you will not be charged again and your remaining credits can no longer be used.
  • Fotello reserves the right to modify or discontinue features, pricing, or credit costs with or without notice.

Credits:

  • Generating a video uses credits. The credit cost of a video is shown before you generate it.
  • Each billing period, your credit balance is reset to the number of credits included in your plan. Unused credits do not roll over.
  • Credits can only be used while your plan or trial is active. Credits have no cash value and cannot be transferred, sold, or exchanged.
  • If a video cannot be started because of an error on our side, the credits used are returned. Fotello may restore credits in other cases at its discretion.

4. Your Recordings and AI Content

Ownership:

  • You retain ownership of the videos and audio you record or upload in the Service to create your avatar ("Recordings").
  • You may use the videos you create with the Service for your business, subject to these Terms and Conditions.

Data Usage:

By using the Service, you grant Fotello a worldwide, non-exclusive, revocable license to:

  • Store and process your Recordings, and use your likeness and voice, solely to create your avatar and the videos you request.

Your Responsibilities:

  • You confirm that you are the person shown in your Recordings, or that you have that person's permission.
  • AI-generated content may contain errors or may not look or sound exactly like you. Review it before you publish it. You are responsible for how you use and share it, including making sure the listing details in your videos are accurate.
  • Recordings, avatars, and videos belong to your team's account and can be used by members of your team.

5. Privacy

Your use of Fotello is subject to our Privacy Policy, which explains how we collect, store, and use your data, including your Recordings.

Some features are provided by third parties. Live makeup is powered by Snap Camera Kit and is also subject to Snap's Terms of Service, which you accept when you first use it.

6. Restrictions

You agree not to:

  • Reverse-engineer, decompile, or tamper with the Service.
  • Use the Service for unlawful or malicious purposes.
  • Use the Service to develop competing platforms or services.
  • Create avatars or videos of another person without their permission, or use the Service to impersonate or mislead others.
  • Use AI-generated content in a way that is deceptive, defamatory, or unlawful.

7. Modifications and Updates

Fotello may periodically update the Service, which may add, modify, or remove features. Continued use constitutes acceptance of these updates.

8. Disclaimer of Warranties

The Service is provided "as-is" and "as available." Fotello disclaims all warranties, express or implied, including fitness for a particular purpose.

9. Limitation of Liability

To the extent permitted by law, Fotello will not be liable for damages, including loss of data or profits, arising from your use of the Service.

10. Termination

Fotello may terminate or suspend your account for violations of these Terms and Conditions or other lawful reasons. Upon termination, your license to use the Service will end.

11. Governing Law

This Agreement is governed by the laws of British Columbia and Canada. Any disputes shall be resolved exclusively in the courts of British Columbia.

12. Changes to Terms

Fotello may update these Terms and Conditions at any time. Changes will be posted on this page, and continued use of the Service constitutes acceptance.

13. Consent to Agreement

By checking the box during sign-up, you confirm that:

  • You agree to these Terms and Conditions.
  • Your Recordings may be used by Fotello as described above.
